These general conditions apply to all agreements made through the website www.maracatucaffe.it after written acceptance by the owner of maracatucaffe.it. These conditions take priority over any formality written or printed by the buyer. By confirming the order, the buyer declares to be in agreement with the current conditions. Any addenda to these general conditions will be valid only after written acceptance by the owners of www.maracatucaffe.it.
Orders are made on the website www.maracatucaffe.it The buyer will receive a confirmation email of the purchase made. Special offers indicated on the site are not binding. They become obligatory only after order confirmation.
maracatucaffe makes coffee shipments throughout Italy with Bartolini courier and maracatucaffe Express courier for shipments to Rome.
Shipping is free throughout Italy for all orders exceeding €49.00. For orders under €49.00, the shipping costs charged are €9.90.
Shipping to Rome takes place with our Express couriers, it is free for orders over €29, for orders under €29 the shipping costs charged are €4.90.
For all payment methods (except cash on delivery), the goods are shipped only after receipt of payment. In the case of cash on delivery payment, shipment occurs at the same time as order receipt. All espresso capsules (original and compatible), coffee pods, coffee beans, and coffee machines are available in stock except in exceptional cases.
The estimated delivery times are always highlighted in the cart. In case of force majeure, the owner of www.maracatucaffe.it has the right to verify and modify the situation without judicial intervention, delay delivery until the removal of the major cause, without the buyer having the right to claim a refund.
The invoice is attached to the order for all orders.

Delivery times are applicable for all coffee capsule orders made before 12 noon. Orders made after 12 noon are considered postponed by one day. Delays are possible due to force majeure (not attributable to maracatucaffe.it or the courier).
These timeframes are valid for orders paid by card, Apple Pay, Google Pay, PayPal, Satispay, and cash on delivery. For coffee orders with bank transfer payment, delivery times refer to the moment maracatucaffe receives payment confirmation from the bank.
If the coffee is temporarily unavailable in stock, maracatucaffe will indicate it directly on the site. If despite our attention you purchase products that are temporarily unavailable, you will be immediately contacted via email or telephone. You will be provided with new delivery times.
The prices of products indicated on the maracatucaffe.it site are guaranteed, except in cases of force majeure. Prices are indicated in EURO and include VAT. Shipping costs are not included (Except for minimum spending amounts indicated, where free shipping is provided).
You can choose from different payment methods, according to the most modern security standards:
(Visa, VisaElectron, MasterCard circuits), through the PayPal service, Apple Pay, Google Pay, Satispay, by bank transfer or cash on delivery (in cash).

IMPORTANT: Carefully verify the shipping address indicated on PayPal.
If the shipping address within the order does not match the shipping address left on PayPal, we will ship the goods to the address indicated on PayPal.
It is not possible to refuse the package with payment on delivery when it has already been shipped. It is possible to cancel the order by contacting Customer Service only before shipment is made. In case of refusal/non-acceptance of the package from the courier, the recipient will have to pay all costs due (shipping cost, return cost, and storage).
Online purchasing is a real sales contract.
In case of your direct refusal of the package upon delivery OR NON-PAYMENT, you will be notified via email or telephone for clarification. If we do not receive a response by phone or email within 10 days, we will return the shipment and you will be charged the entire cost of the shipment itself as well as the cost of returning to the sender and storage, according to the methods that will be communicated to you.
If a package is refused, all shipping costs remain the responsibility of the ordering customer and are increased by the costs of return to sender and storage for an additional cost of €17. You will be explicitly asked to pay the amount within a certain period.
In case of non-payment, the case will be entrusted to our lawyers for debt collection.
The legal warranty of conformity is provided by the Consumer Code (articles 128 and following) and protects the consumer in case of purchase of defective products, which function poorly or do not correspond to the use declared by the seller. The consumer, in case of receipt of defective or damaged goods, can assert his rights regarding the legal warranty directly to the manufacturer of the purchased product.
Products purchased on the website www.maracatucaffe.it will be delivered in accordance with the information communicated by the buyer. By accepting these purchase conditions, the buyer confirms this assumption. maracatucaffe guarantees the quality and effectiveness of the delivered products, as indicated in the manufacturer's information. Products purchased on www.maracatucaffe.it are in their original packaging (blister or flowpack). The external packaging is created by maracatucaffe.it ensuring safe and protected packaging of the goods. The buyer agrees to carefully read the instructions and conditions of use before using the products. In case of doubt, the buyer agrees to contact the manufacturer before using the product. The site owner is not responsible for any technical defects of the packaged product or any incorrect indications in the manufacturer's conditions. The owner of www.maracatucaffe.it cannot assume responsibility for the buyer's lack of appreciation of the taste/aroma/consistency/appearance of the purchased product nor for any intolerances to the products. maracatucaffe.it is also not responsible if the defect is due to negligence in maintenance, intentional degradation, or negligent application of the manufacturer's instructions and conditions.
For purchases of machines and/or accessories made via internet, call center, and outside commercial premises, it will always be possible to exercise the right of withdrawal according to the provisions of the Consumer Code (Legislative Decree 21.02.2014 No. 21, in G.U. 11.03.2014), within the term of 14 calendar days from the delivery of the good (or the last good for multiple orders), by contacting customer service by telephone or WhatsApp at 0690202432 or by sending an email to info@maracatucaffe.it for return procedures. The good must be returned at the care and expense of the consumer within 14 days of receiving the good.
Only returns of merchandise in perfect condition and in their original packaging, accompanied by the relevant purchase invoice, will be accepted.
If the returns have been made in accordance with the above, maracatucaffe.it will issue a refund or a credit in favor of the customer for subsequent purchases, within a maximum of 14 days from when it became aware of the withdrawal. maracatucaffe.it may withhold the refund until it has received the goods. Return shipping costs are the responsibility of the sender. The consumer is solely responsible for the diminution in value of the goods resulting from handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.
The return of products will not normally be accepted as per article 59 of the Consumer Code, for which goods the right of withdrawal is excluded.
In particular, this right is excluded for the supply of goods:
(a) Made to measure or clearly personalized.
(b) That risk deteriorating or expiring rapidly (products purchased in the Short Expiration Offers section).
(c) Sealed, which are not suitable for return for hygienic reasons or connected to health protection and have been opened after delivery.
In compliance with Legislative Decree 21/2014, the return of food products such as pods, capsules, cookies, chocolate, or sugar will not be accepted. Exceptions are cases where anomalies (crushed capsules and/or with missing parts, packaging defects, etc.) cannot be detected by the customer at the time of purchase: in this case, replacements will be accepted, subject to verification by maracatucaffe.it.
The personal information that the buyer communicates to the website www.maracatucaffe.it, in the context of the order, is stored in a computerized customer database. The owner maracatucaffe.it uses this information only to communicate information to the buyer and for order processing. Commercial communications (sending of Newsletters) occur only after free and explicit consent from the user. The buyer can, at any time, modify and delete this information. Personal information will never be communicated to third parties.
Order-related communications
By accepting these Terms and Conditions, the customer authorizes Maracatu Caffè to contact them via SMS or phone exclusively for purposes related to the processing of their order, such as confirmation requests, shipping updates, missing information, or availability issues. These communications will not be used for advertising or promotional purposes.
For all disputes that may arise, the competent court is linked to the supplier's court of belonging or where the company is headquartered.
